Terms and Conditions for the "Sustainability in the Ski Resort" Contest
Participation in the above-mentioned contest is free of charge, independent of the purchase of products from the mentioned companies/brands, and is exclusively subject to these terms and conditions. By acknowledging these terms and conditions and deciding to participate in this contest, these terms and conditions are accepted.
I. Organizer
The organizer of this contest is:

(hereinafter referred to as the "Organizer")
II. Eligibility
All natural and legally competent persons who have reached the age of 18 and work in a ski resort are eligible to participate. Employees of the Organizer, as well as their immediate family members and all persons involved in the conception and implementation of this contest, as well as their immediate family members, are not eligible to participate. The term "immediate family members" includes all of the following: spouses, domestic partners, children or stepchildren (whether biological or adopted), parents, stepparents, grandparents, step-grandparents, siblings, stepsiblings.
Each participant is only allowed to participate in the contest once. Each participant can only participate in their own name; the personal details must be truthful. It is strictly prohibited to use multiple addresses or profiles to increase the chances of winning. Participation with false identities or with the identities of third parties is not allowed and will result in disqualification.
III. Disqualification
The Organizer reserves the right to disqualify persons from participation at its own discretion if there are justified reasons. This is the case, for example, if there is reason to believe that a participant is violating applicable law, the rights of third parties, the provisions of these terms and conditions, or the rules of the game, especially in the case of:
- Manipulations in connection with access to or the conduct of the contest
- False or misleading information in connection with participation in the contest
- Offensive, derogatory, or discriminatory contributions
- Contributions glorifying violence, xenophobic, pornographic, or racist contributions
- Contributions with political or advertising content
- Contributions that violate competition, trademark, or copyright law
Regardless of any further rights, the Organizer is entitled in this case to take the following measures in particular:
- Immediate disqualification of the participant
- Deletion and/or blocking of the participant's contributions
- Subsequent revocation and, if necessary, reclaiming of the prize and drawing a new winner
IV. Contest Participation
To participate in the contest, the following must be observed and followed:
Participants must participate in the contest within the participation period.
Participation is via a mobile device.
By accessing a link (https://forms.office.com/e/FJF2UACHSH), the participant reaches the quiz.
To participate in the draw, the participant must correctly and completely answer all questions of the contest at(https://forms.office.com/e/FJF2UACHSH).
Finally, the participant must enter their first name, last name, date of birth, and email address and submit the questionnaire.
V. Participation Period
Participation is only possible within the participation period. Participation attempts received after the end of the participation period will not be considered in the draw.
Participation in the contest is possible from 06.05.2025, 09:00, until 09.05.2025, 23:59.
VI. Prize
Main prize: Among all valid participants, ten PistenBully Fanshop vouchers of €50 each will be drawn.
A cash payout, payment in kind, exchange, or transfer of the prize to other persons is excluded. The winner can waive the prize. In this case, the Organizer reserves the right to draw a new winner.
VII. Winner Determination
The winner will be determined within 4 weeks after the end of the participation period in a random draw among all participants who qualified for the draw by participating in the contest within the participation period and complying with the other terms and conditions.
VIII. Winner Announcement
The winner announcement by mentioning the first name and place of residence of the winner will take place within 4 weeks after the winner determination by email. The winner must respond within one week after the winner notification to the email address mentioned there. If the winner does not respond within one week after the winner notification, the prize will not be awarded. If the provided contact details are incorrect, the Organizer is not obliged to find the correct addresses. Disadvantages resulting from the provision of incorrect contact details are the responsibility of the participant. If a prize cannot be delivered for reasons not attributable to the Organizer, the prize claim expires without replacement.
X. Prize Delivery
The prize will be sent by email.
Any costs incurred for the shipment of the prizes will be borne by the Organizer. Additional costs associated with claiming the prize are the responsibility of the winner. The winner is responsible for any taxation of the prize.
XI. Early Termination of the Contest
The Organizer reserves the right to terminate the contest at any time, even without observing deadlines and without prior notice and without giving reasons, in whole or in part, or to change its course if it is not possible to guarantee the proper and planned conduct of the contest for technical reasons (e.g., computer virus, manipulation of or errors in software/hardware) or legal reasons.
XII. Liability
For liability of the companies mentioned in the contest for damages, the following liability exclusions and limitations apply, without prejudice to the other statutory requirements for claims:
The Organizer is liable without limitation if the cause of the damage is based on intent or gross negligence.
Furthermore, the Organizer is liable for the slightly negligent violation of essential obligations, the violation of which endangers the achievement of the purpose of the contract, or for the violation of obligations, the fulfillment of which makes the proper conduct of the contest possible in the first place and on the compliance with which the contractual partners regularly rely. In this case, however, the Organizer is only liable for the foreseeable, contract-typical damage. The Organizer is not liable for the slightly negligent violation of obligations other than those mentioned in the preceding sentences.
The above limitations of liability do not apply in the event of injury to life, body, or health, for a defect after the assumption of guarantees for the quality of a product, and in the case of fraudulently concealed defects. Liability under the Product Liability Act remains unaffected.
To the extent that the liability of the Organizer is excluded or limited, this also applies to the personal liability of employees, representatives, and vicarious agents of the Organizer.
The Organizer cannot be held responsible for any technical malfunctions, especially failures of the network, electronics, or computers.
The participant confirms and warrants to the Organizer that their contribution within the contest does not violate legal provisions, good morals, or the rights of third parties (e.g., trademark, name, copyright, data protection, or youth protection law). In particular, the participant also undertakes to obtain the legally required consents of the parties involved/affected/entitled, for example, the photographers or the persons depicted or mentioned, before posting texts, images, or other content. The participant indemnifies the Organizer from any claims of third parties arising from a violation of these obligations and agrees to compensate the Organizer for all resulting damages, including reasonable legal defense costs.
Subject to the above provisions, warranty claims regarding the prizes are excluded.
XIII. Data Protection
To participate in the contest, the provision of personal data (first and last name, email address) is necessary. The participant assures that the information provided about their person is truthful and correct.
The Organizer is responsible for the collection, processing, and use of personal data of the participants. The Organizer will use the participant's personal data and other personal data only within the framework of the statutory provisions of data protection law. XIV. Final Provisions
Legal recourse regarding the conduct of the contest and the drawing of the prize itself is excluded.
Should any provision of these terms and conditions be or become wholly or partially invalid, the validity of the remaining terms and conditions shall not be affected. Instead of the invalid provision, the legally permissible regulation that comes closest to the economic sense and purpose expressed in the invalid provision shall apply. The same applies in the event of a regulatory gap in these terms and conditions.
The Organizer reserves the right to change these terms and conditions at any time with effect even within the ongoing contest, insofar as this is necessary due to changes in the law, changes in case law, or other changes in the framework conditions.
These terms and conditions and the other legal relationships existing between the participants and the Organizer within the framework of the contest are subject to the law of the Federal Republic of Germany. The exclusive place of jurisdiction is, as far as legally permissible, ULM, Germany
